BOISE — The Ada and Canyon County sheriff’s offices will soon join a federal effort to crack down on criminal illegal aliens.

As it stands now, everyone who is booked into the jails is fingerprinted.  Those prints are then sent to the state and FBI for processing.

In just a couple weeks, the prints will begin going to ICE — the U.S. Immigration and Customs Enforcement.

ICE agents are at the Ada County Jail almost daily speaking with inmates who have a questionable immigration status.

“If we’re able to take a suspected criminal alien off the streets immediately instead of them going back out to the community to possibly commit more crime, that’s how it really makes it a safer community for all of us,” said Chief Deputy Ron Freeman of the Ada County Sheriff’s Office.

Right now, ICE agents scroll the sheriff’s website for inmates on their watch list.

Soon, the same fingerprints that Ada County already gets from inmates, will automatically link up to the ICE database.  Agents could be tipped off right away.

“If there’s someone that ICE is looking for we will immediately know that, where right now there is a delay and often times that delay meant those people would be getting out of jail before that information would be received by ICE,” said Freeman.

Last year, ICE took more than 100 inmates from the Ada County Jail into their custody.  The sheriff’s office predicts once the new system goes online in a couple of weeks; that number will be even higher.

“We had over 20,000 bookings last year. That’s a lot of people. Not only locals but people from outside our area are brought into our jail,” said Freeman.

Fewer of those inmates could free up bed space in the local jails and save taxpayers money.  It costs taxpayers an estimated $60 a day to house one inmate.

“If someone does not need to be in this community because they’re a foreign national illegally in this area, when ICE takes them back they’re not in our community to possibly commit crimes. It adds to the safety of this community,” said Freeman.

The sheriff’s office says 20 other states are linked up with the ICE database, and Ada and Canyon Counties are the first in Idaho to participate.

ICE plans to spend more than $1 billion this year on criminal alien enforcement efforts.

A Nebraska town, angry over a surge in the number of Hispanic residents, is voting today in a referendum on a new law that would require foreign nationals to get a licence to live in the town.

The referendum in Fremont has been prompted by a sharp rise in Hispanic people drawn by work at local meatpacking plants combined with fears over job losses and demand placed on the town’s social services because of the economic downturn.

If approved, tenants who are not US-citizens would be required to get an “occupancy licence” from the city council. Even residents of nursing homes would be required to obtain such a licence.

Federal law requires employers to verify the immigration status of workers but the proposed Fremont law would also open violators to local sanctions. Supporters insist it is not racist and is essential to protect jobs, healthcare and education for local people because the town’s Hispanic population has surged from 165 to more than 2,000 in the past 20 years.

It is unclear what proportion of those are in the US illegally but the big meatpacking plants where many work say they only employ people whose immigrant status has been verified. The Fremont Tribune has reported cases of Hispanic people, who are legal residents, being verbally abused and told to return to Mexico.

Jerry Hart, one of the three sponsors of the legislation, told the Fremont Tribune that the proposed law is in part a security measure. “The federal law was put into place for a reason – to control how many people come into this country and to regulate the people, so they don’t have communicable diseases and are not bringing in drugs or having criminal records and these people who are sneaking in – you don’t know what you’re getting. We could have terrorists and gang members and people involved in drugs,” he said.

John Wiegert, another of the sponsors of the referendum, said: “A lot of them are coming here for the American dream and they’re causing nothing but an American nightmare to me.”

WASHINGTON – U.S. Rep. Gabrielle Giffords Tuesday announced the White House has agreed to her requests to deploy National Guard troops to the U.S. border with Mexico.

Giffords called for the Guard's deployment immediately after the March 27, 2010, murder of Cochise County rancher Rob Krentz.

Giffords also says in a statement Tuesday that President Barack Obama will request $500 million in funding for border security.

In 2006, President George W. Bush sent thousands of troops to the border to perform support duties that tie up immigration agents. The troops wouldn't perform significant law enforcement duties.

That program has since ended, and politicians in border states have called for troops to be sent there to curb human and drug smuggling and prevent Mexico's drug violence from spilling over into the United States.

EDMONDS, Wash. – The KING 5 Investigators have learned that an illegal immigrant accused of raping a woman in Edmonds Sunday has been deported nine times. That's much more than previously reported.

Immigrations and Customs Enforcement won't comment on the case of Jose Lopez Madrigal. But KING 5 got the information through confidential sources and documents.

Larry Klein was the man who heard the alleged victim's cries for help. Police say the suspect pulled the woman off the street to a dumpster and raped her.

“I could see the back of his head. I could see his pants were down. I could see her lying on the ground. I could hear her crying, but I couldn't really see her face,” said Klein.

Klein called police, who quickly arrested the suspect. But learning his identity took much longer because of some 30 aliases. It was only through fingerprints that they identified him as Madrigal, a Mexican citizen.

Madrigal's arrest and immigration record includes a staggering number of contacts with law enforcement since 1989. That's the year he was convicted of theft using a firearm in California.

He was deported a couple of times after that. Then in 1999, he was arrested for drug sales in both San Diego and San Francisco. Records show that he was deported three times that year between April and August.

He was arrested for drugs again in Stockton, Calif. in 2000. In 2002, he pleaded to third degree sexual assault in Denver. Later that year, he was deported again. And in 2003, records show he was deported three more times.

People who live near the scene of Sunday's alleged rape wonder how it could keep happening.

“Makes you wonder, what are we doing wrong? How is he getting back in here?” said Kirby Aumick.

“It’s troubling. I mean, if this man should not have been in this country, he should have been behind bars then, really, this is a senseless tragedy,” said Klein.

According to our sources, Madrigal’s last contact before Sunday was around 2003. So, it's not clear how much of that time Madrigal was in this country.

Immigration and Customs Enforcement has refused to comment on the case which started making national headlines when it was learned that Madrigal had been deported several times prior to the Edmonds case.

In reviewing records and talking with confidential sources, the KING 5 Investigators learned just how extensive Madrigal’s immigration and arrest record is.

They found he was first deported in California in 1989 and since then he’s returned from his Mexican homeland and been arrested for drug crimes, a sex assault in Colorado and other offenses.

One criminal justice source says Madrigal is a “poster boy” for the federal governments ineffectiveness at keeping the most serious “criminal aliens” – illegals who commit crimes – out of the United States.

There was a recent story in the news about the owner of the Arizona Suns renaming his team “Los Suns” in solidarity with the illegal aliens and as a protest against the new Arizona immigration law #1070. There’s just one little problem: 70 percent of the people of Arizona support the new immigration law and only the liberal ivory tower elitists (who don’t have to live near the illegals) are protesting the law while the vast majority of White Americans enthusiastically support it.

Well, an enterprising fan of the Suns showed up at the now notorious game, where the Arizona Suns became “Los Suns”, wearing a custom-made T-shirt boldly proclaiming his support for the new law. The fan had purchased an expensive seat along with a friend with a similar T-shirt right above the Arizona Suns’ coach and the TV cameras kept getting shots of his T-Shirt supporting Arizona’s new immigration law #1070. All the people sitting around him were giving him the “thumbs up” sign.

An article on the John and Ken website reports “As the Phoenix Suns took the court last week wearing ‘Los Suns’ jerseys in protest of Arizona’s new immigration law, Jim Clark had his own protest. Clark, CEO of Republic Monetary Exchange, had his own shirt made in response to the team’s move. The Phoenix resident wore his bright orange long-sleeved shirt that read ‘Viva Los 1070′ in the Wednesday playoff game against the San Antonio Spurs. Clark said he decided to wear the shirt after learning the Suns were taking a stance against Arizona’s new immigration law, known as Senate Bill 1070.”

The pro-illegal alien owner of the Suns noticed this guy getting on the TV screen over and over and finally blew his top. Security guards were sent after the T-shirt guy and his friend, who resisted their thuggish behavior. At first the security thugs claimed that they were removing him for trying to make a political statement. The law however had already passed, and all they were doing was supporting a valid law of the state of Arizona (while the owner of the Suns was showing disrespect for the new Arizona law).

The security guards backed down and let the pro-immigration law fans return to their seats, and the people sitting around them gave them a round of applause on their return.

The Arizona Department of Education recently began telling school districts that teachers whose spoken English it deems to be heavily accented or ungrammatical must be removed from classes for students still learning English.

State education officials say the move is intended to ensure that students with limited English have teachers who speak the language flawlessly. But some school principals and administrators say the department is imposing arbitrary fluency standards that could undermine students by thinning the ranks of experienced educators.

The teacher controversy comes amid an increasingly tense debate over immigration. Arizona Gov. Jan Brewer this month signed the nation’s toughest law to crack down on illegal immigrants. Critics charge that the broader political climate has emboldened state education officials to target immigrant teachers at a time when a budget crisis has forced layoffs

Just a week after signing the country’s toughest immigration bill into law, Arizona Gov. Jan Brewer now must decide whether to endorse another bill passed by her state legislature — one that outlaws ethnic-studies programs in public schools.

The bill forbids Arizona schools from using any curriculum that promotes “the overthrow of the United States government” or “resentment toward a race or class of people.” It also disallows any curriculum that’s “designed primarily for pupils of a particular ethnic group” or that seeks to “advocate ethnic solidarity instead of the treatment of pupils as individuals.”

Arizona’s superintendent for public instruction, Tom Horne, has said he’s backing the measure because ethnic-studies programs encourage “ethnic chauvinism”; he’s also suggested that such programs could breed secessionist sentiment among Hispanic students.

PHOENIX – Gov. Jan Brewer ignored criticism from President Obama on Friday and signed into law a bill supporters said would take handcuffs off police in dealing with illegal immigration in Arizona, the nation’s busiest gateway for human and drug smuggling from Mexico.

With hundreds of protesters outside the state Capitol shouting that the bill would lead to civil rights abuses, Brewer said critics were “overreacting” and that she wouldn’t tolerate racial profiling.

]”We in Arizona have been more than patient waiting for Washington to act,” Brewer said after signing the law. “But decades of inaction and misguided policy have created a dangerous and unacceptable situation.”

Earlier Friday, Obama called the Arizona bill “misguided” and instructed the Justice Department to examine it to see if it’s legal. He also said the federal government must enact immigration reform at the national level – or leave the door open to “irresponsibility by others.”

“That includes, for example, the recent efforts in Arizona, which threaten to undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and their communities that is so crucial to keeping us safe,” Obama said.

The legislation, sent to the Republican governor by the GOP-led Legislature, makes it a crime under state law to be in the country illegally. It also requires local police officers to question people about their immigration status if there is reason to suspect they are illegal immigrants; allows lawsuits against government agencies that hinder enforcement of immigration laws; and makes it illegal to hire illegal immigrants for day labor or knowingly transport them.

The law sends “a clear message that Arizona is unfriendly to undocumented aliens,” said Peter Spiro, a Temple University law professor and author of the book “Beyond Citizenship: American Identity After Globalization.”

DENVER — Not only did Bruno Kirchenwitz’s U.S. Border Patrol baseball cap help get him fired, it almost got him shot.

Mr. Kirchenwitz, 54, was dismissed from his part-time job at 7-Eleven in Basalt after he was threatened by two Hispanic men who are suspected of later pumping five bullets into the store.

Mr. Kirchenwitz, who left work less than an hour before the shooting, was terminated by Southland Corp., which owns the 7-Eleven chain of convenience stores, for violating the company’s “non-confrontation policy.”

He contends he was fired for his views on illegal immigration and seeks a lawyer to sue Southland on his behalf.

“I want to put the hurt on their pocketbook because that’s all they care about, apparently,” Mr. Kirchenwitz said.

The June 26 episode transformed him into a kind of folk hero on talk radio and within the secure-borders movement.

WALNUT CREEK — More than 40 employees at the downtown Target store quit their jobs after an internal probe raised suspicions about their immigration status, according to lawyers who have met with the workers.

Managers summoned the overnight crew of the North Main Street department store to meetings last month and gave workers the chance to prove their eligibility to work in the United States by bringing in the proper documents, the lawyers and Target representatives say.

Most of the questioned workers voluntarily resigned, Target spokeswoman Kate Gillen said. The Minnesota-based retailer would not say how many workers left the Walnut Creek store, but advocates for the employees say it was dozens.

“Forty-five people are without a job,” said lawyer Rocio Avila of La Raza Centro Legal, a San Francisco legal group pressing Target for more information. “Many of the workers there were long-term workers. There was one gentleman who had been (at Target) for 19 years, and the average was five to six years. These weren’t temporary workers, seasonal workers for the holiday season. These were loyal workers who had been there for a long time.”

Avila met with many of the workers and said the group, all of them Spanish speakers, are confused about what happened Nov. 11 and Nov. 12, when supervisors, paychecks in hand, held staff meetings at the beginning of the graveyard shift.

It is unclear, she said, why the predominantly Latino overnight shift was targeted while other employees were not.

“None of the workers are able to articulate exactly what happened,” Avila said. “None of these workers ever got anything in writing. None. That’s a huge red flag.”

The store’s probe of so many of its workers was unusual, especially for a brand-name retailer, but may become more common as U.S. Immigration and Customs Enforcement heightens its enforcement of employers who hire illegal workers, whether knowingly or not. The agency this year has launched civil inspections of hundreds of California employers, though Gillen made clear that the Target store was not one of them.

The company, she said, launched its internal investigation on its own after fielding allegations — she will not say from whom — that some of its Walnut Creek employees were working at the store illegally. All American workers must fill out I-9 forms on the first three days of a job to verify their identity and authorization to work legally in the country, so the store began reviewing those forms.

The employees who were being investigated were “given the opportunity to provide Target with further information and documents to reestablish their ability to work in our store,” Gillen said in a statement.

Although the retailer uses the program elsewhere in the country, Target said the Walnut Creek store is not registered for E-Verify, the federal database that helps companies confirm the legal status of their workers.

Most of the employees worked late at night and early in the morning, when the store is closed, but employees use forklifts, ladders and their hands to stock the store with newly arrived products. Others clean the store, which has been open since 1999.

The retailer gave no warning to county officials about firing a large group of workers. Companies are required to notify local government following a mass layoff but not if the employees were fired for a special reason or left voluntarily, said Stephen Baiter, executive director of the Workforce Development Board of Contra Costa County.

Three illegal immigrants are being held on $50,000 bonds for a vandalism and mayhem rampage that included beating a pregnant woman with a hose.

The three men, Jose Ramirez-Lopez, 26, Christian Onofre-Caba, 19, and Rosalino Gaspar, 25, were arrested Sunday north of Willcox, Arizona, in connection with assault on a pregnant woman and crime spree that includes charges of aggravated assault, kidnapping and burglary, Carol Capas, spokeswoman for the Cochise County Sheriff’s Department, told the Arizona Range News.

Police said the men smashed windows in one home, roamed the area making noise and acts of vandalism. They are also suspected of attacking a man with a small wooden bat and a knife.

They reportedly entered a home and assaulted a woman who was eight-months pregnant by repeatedly striking her with a rubber hose, before chasing a second man back to the bedroom and assaulting him with fists and a knife.

Legal price of hiring illegals

A Mishawaka company has a legal price to pay—for hiring illegal aliens.

Today, Janco Composites (as a corporation), and its President (as an individual), pleaded guilty to criminal charges in federal court in South Bend.

Janco Composites faces five years of probation and a fine of $210-thousand to be paid in installments over a two year period.

Janco President Douglas Jaques—as an individual– faces one year of probation and a fine of $30-thousand.

The plea agreement indicates that Janco had a pattern and practice of hiring illegal Mexican immigrants, and that one of the illegal workers was part of the Human Resources Department.

In March of 2007, officials raided Janco’s Mishawaka factory. During the raid, 36-alleged undocumented workers were arrested.

Open Border Shyster John McCain Deserves a Dunce Cap

In the days of yore, students who did not make a valid attempt to learn their lessons and acquitted themselves badly at recitation time were sometimes relegated to a corner of the room in order to shame them. Sometimes a pointed cap would be put on their heads as a warning to other students: learn your lessons or you’ll be the next fool on display.

In today’s world, putting a student in a corner – much less with a dunce cap – would land the teacher in hot water, not the student who would rather play video games than study history or science. But I’d like to slap a big, fat dunce cap on John McCain, the man who claims to have learned his lesson when it comes to border security and amnesty for illegal aliens.

As a quick refresher, proposed bills with amnesty provisions – the McCain-Kennedy immigration bill and the Dream Act – were both soundly trounced in Congress. Why? Because Americans, tired of our borders resembling a revolving door and illegal aliens barging in and demanding the rights of citizens, made their voices heard loud enough for the bills to be voted down. The Maverick, as McCain is endearingly called by the media, said, “I got the message. We will secure the border first, then move on to other issues.”

How Eisenhower solved illegal border crossings from Mexico

WASHINGTON – George W. Bush isn’t the first Republican president to face a full-blown immigration crisis on the US-Mexican border.

Fifty-three years ago, when newly elected Dwight Eisenhower moved into the White House, America’s southern frontier was as porous as a spaghetti sieve. As many as 3 million illegal migrants had walked and waded northward over a period of several years for jobs in California, Arizona, Texas, and points beyond.

President Eisenhower cut off this illegal traffic. He did it quickly and decisively with only 1,075 United States Border Patrol agents – less than one-tenth of today’s force. The operation is still highly praised among veterans of the Border Patrol.

Although there is little to no record of this operation in Ike’s official papers, one piece of historic evidence indicates how he felt. In 1951, Ike wrote a letter to Sen. William Fulbright (D) of Arkansas. The senator had just proposed that a special commission be created by Congress to examine unethical conduct by government officials who accepted gifts and favors in exchange for special treatment of private individuals.

General Eisenhower, who was gearing up for his run for the presidency, said “Amen” to Senator Fulbright’s proposal. He then quoted a report in The New York Times, highlighting one paragraph that said: “The rise in illegal border-crossing by Mexican ‘wetbacks’ to a current rate of more than 1,000,000 cases a year has been accompanied by a curious relaxation in ethical standards extending all the way from the farmer-exploiters of this contraband labor to the highest levels of the Federal Government.”

Years later, the late Herbert Brownell Jr., Eisenhower’s first attorney general, said in an interview with this writer that the president had a sense of urgency about illegal immigration when he took office.

America “was faced with a breakdown in law enforcement on a very large scale,” Mr. Brownell said. “When I say large scale, I mean hundreds of thousands were coming in from Mexico [every year] without restraint.”

SAN DIEGO—A former U.S. Border Patrol agent was sentenced Friday to 36 months in federal prison for helping immigrant smugglers in exchange for cash.

Jose Olivas Jr., 46, pleaded guilty in October to conspiring to smuggle aliens and launder money. A 10-year veteran of the Border Patrol, he admitted helping more than 100 illegal immigrants get into the U.S. from January 2006 until his arrest a year later.

Prosecutors said he pocketed as much as $15,000 from smugglers, who paid him $100 each time he agreed to act as a scout by driving past a highway checkpoint on Interstate 5 at San Clemente, about 60 miles north of San Diego. If the checkpoint was closed, he would call the smugglers and give them an all-clear to follow with carloads of migrants.

According to Olivas’ plea agreement, he worked with others who brought illegal immigrants from Mexico at border crossings in California, including San Diego. He also admitted showing Border Patrol reports to members of the smuggling ring.

Olivas faced a maximum sentence of 15 years in prison.

There’s a pro-illegal move afoot in Maryland that is infuriating, but not at all surprising. The Democrats control the state, and they’re worse than the Republicans on immigration issues. Governor Martin O’Malley is apparently set to grant illegal aliens in-state tuition prices at state universities.

As states nationwide are embroiled in battles over immigrants’ rights, Maryland lawmakers are again wrestling with the contentious issue — and showing signs of easing some restrictions.

State to Investigate Whether Arizona State U. Broke Law on Aid to Illegal Immigrants

I’m liking Arizona more the more I read.

Arizona’s treasurer plans to investigate whether Arizona State University is breaking a new state law by providing private institutional aid to some of its students who are undocumented immigrants, according to The Arizona Republic.

Dean Martin, the treasurer and a former Republican state legislator, was the lead sponsor of a ballot measure, approved last fall, that bars illegal immigrants from paying in-state tuition at public colleges or receiving state-based financial aid, among other state services.

Thousands of Arizona College Students Denied In-State Tuition – Chronicle.com

While Arizona’s major public universities have had to reclassify hundreds of students from in-state to out-of-state status under a 2006 immigration law, the number is in the thousands for the state’s community colleges, The Arizona Republic reported today.

In all, nearly 4,000 students in the state’s colleges and universities were denied in-state tuition this year and are being charged rates that in some cases are more than three times as high. The law, Proposition 300, requires students to document that they are in the United States legally before they can receive in-state rates.

Arizona’s largest community-college district, the Maricopa County Community Colleges, had the most students who could not document their legal status, with 1,720. The University of Arizona and Arizona State University had earlier numbered their reclassified students only in the hundreds. —Katherine Mangan
