Los Angeles, California – An elevator mechanic formerly employed by Los Angeles World Airports (LAWA) has been sentenced to three years in federal prison for smuggling foreign nationals into the United States by bypassing established security at Los Angeles International Airport (LAX).

Roberto Amaya Canchola, 54, was sentenced yesterday as part of a plea agreement in which he admitted earning $1,800 for each illegal alien he ushered into airport elevators and escorted to taxis outside the terminal.

Canchola was arrested at LAX in August 2008 after agents from U.S. Immigration and Customs Enforcement (ICE) observed him using special access security keys to smuggle four aliens off an arriving Mexicana Airlines flight and through the airport. Canchola escorted the aliens through a series of restricted access elevators and corridors, enabling them to avoid inspection by U.S. Customs and Border Protection (CBP) officers. After guiding the aliens through the airport, he led them to an awaiting taxi outside.

The investigation began in late July 2008 when CBP officers discovered a discrepancy in the number of passengers from a Mexicana flight clearing the airport’s federal inspection area. The four passengers presented false alien registration numbers or Mexican passports without valid visas when boarding the flight in Mexico. A review of LAX surveillance video identified Canchola intercepting the four passengers arriving on the flight and guiding them through the federal inspection area.

Canchola’s badge was confiscated the day of his arrest and deactivated by the Airport Police. Prior to his resignation, Canchola was employed for 23 years by the City of Los Angeles, including 19 years with LAWA.

laraza_hole_stopperPhoenix has become the kidnapping capital of the United States, because of illegal immigration and human smuggling, according to the head of the Phoenix Law Enforcement Association.

In the past year, there were 359 kidnappings in Phoenix, and not one was legitimate involving a truly innocent victim, said Mark Spencer, head of the union which represents more than 2,500 Phoenix police officers. He said all the kidnappings were connected to illegal immigration and the numbers may represent just the tip of the iceberg.

“The investigators up at the violent crimes bureau are estimating that this 359 represents just one-third of the reported kidnappings that take place in Phoenix,” Spencer said.

The resources needed to handle such cases are immense, Spencer said. He said the violent crimes bureau has exceeded its overtime budget by as much as 300 percent in the past year dealing with illegal immigration.

A money drop on just one case can tie up 50 to 60 officers, Spencer said, “to make sure that it’s conducted safely, not only for the officers, but for the victims as well.”

Meanwhile, Spencer said the first month of the Phoenix Police Department’s new policy to deal with illegal immigration is showing results.

On May 21, officers were given the authority to question criminal suspects about their citizenship status and contact federal Immigration and Customs Enforcement agents if they suspect a suspect is in the United States illegally.

Since then, Spencer said, “Stolen vehicles have gone down 29 percent. That’s a double-digit increase. Another thing that’s gone down, which is quite unusual, our priority one or emergency calls for service, have decreased 10 percent.”

“We’re connecting this decrease with the implementation of the immigration policies and the (employer sanctions) legislation that took effect in January,” he said. “So we think it is having a deterrent effect. Now, you add our new and improved policy which allows our officers to contact ICE…”

He added, “We were confident all along that, allowing officers the discretionary ability to contact ICE wasn’t going to interfere with our police responsibilities, all it was going to do was enhance them.”

Spencer said he expects crimes to drop even more.

“I think you’ll see the crime stats improve in favor of the citizens of Phoenix.”

So which is it?

On the one hand, The Associated Press reports a Mexican government claim that migration, mainly to the United States, has fallen dramatically, with fewer Mexicans abandoning their native land to look for work abroad as a result of the worldwide economic downturn.

The AP quotes Eduardo Sojo, who heads up Mexico’s National Statistics, Geography and Information Institute, to the effect that net outflow, legal and illegal, declined more than 50 percent in the 12 months ending last August. Fewer jobs abroad, fewer folks conniving to cross the border — net outflow down 204,000 between August 2007 and August 2008, from 455,000 the previous year. But wait.

Fox News says, “Federal immigration officials are reporting a surge in the number of Mexicans crossing the border to seek asylum in the U.S., an increase analysts say is due to the drug violence and criminal activity that claimed a record 5,300 lives in Mexico last year.”

mccain_kennedyWASHINGTON (AP) – The $800 billion-plus economic stimulus measure making its way through Congress could steer government checks to illegal immigrants, a top Republican congressional official asserted Thursday.

The legislation, which would send tax credits of $500 per worker and $1,000 per couple, expressly disqualifies nonresident aliens, but it would allow people who don’t have Social Security numbers to be eligible for the checks.

Undocumented immigrants who are not eligible for a Social Security number can file tax returns with an alternative number. A House-passed version of the economic recovery bill and one making its way through the Senate would allow anyone with such a number, called an individual taxpayer identification number, to qualify for the tax credits.

A revolt among GOP conservatives to similar provisions of a 2008 economic stimulus bill, which sent rebate checks to most wage earners, forced Democratic congressional leaders to add stricter eligibility requirements. That legislation, enacted in February 2008, required that people have valid Social Security numbers in order to get checks.

The GOP official voiced concerns about the latest economic aid measure on condition of anonymity because he was not authorized to discuss it publicly.

Republicans have already blasted the package for including what they argue is wasteful spending and omitting tax cuts for wealthier people and businesses they say are needed to jump-start the anemic economy.

Not a single Republican voted for an $819 billion version of the plan when it passed the House on Wednesday.

GOP senators arranged a midday news conference to voice their concerns.

Peter Lynch found quilty of destroying POS Mexican flag flying on U.S. soil

A man who admitted lowering and tearing up a Mexican flag that was flying by itself on the UNM campus last September has been found guilty by a jury of criminal damage to property.

Peter Lynch received a deferred six-month sentence on supervised probation.  He also must perform 48 hours of community service, attend anger management, replace the flag and pay court and probation fees.

In closing arguments Wednesday morning, the defense argued that Peter Lynch’s action should be protected under the first amendment.

The prosecution noted that the flag was not Lynch’s to damage.  It said the fact that Lynch admitted to taking the flag down and then destroying it required the jury to return a guilty verdict.

On Tuesday, Lieutenant Pat Davis of the UNM Police Department testified that when Lynch saw the Mexican flag flying without an American flag, he first reported it to the office of UNM’s Dean of Students, then to the Officer of Veteran Affairs, but wasn’t satisfied with the response.

Davis says Lynch, a veteran of the U.S. Air Force, then began to take the flag down as others gathered nearby.

“At least one person encouraged him by saying, ‘Yeah, brother, go ahead,’ and ‘Thank you,’ and some other things he heard in the background,” Davis says Lynch explained.

Davis says that Lynch told him he then became emotional and “took the flag in his hands and ripped it in half.”

UNM ROTC students admit that they had neglected to lower the Mexican banner when they lowered the U.S. flag at sunset last September because they thought a Mexican student organization would do that.

Davis said that Lynch told officers that the lone Mexican flag flying without an U.S. flag “could be perceived as a sign of war or that the territory had been taken over by another country and he felt it was his obligation to remove the flag and enforce that code.”

Davis says that, in the end, Lynch told police that his emotions got the better of him.

“He knew it was wrong,” Davis testified, “he shouldn’t have done it, but he just got caught up in the emotion of the moment and thought [what he did] was appropriate at the time.”

LOS ANGELES — During a decade in the U.S., Mexican immigrant Linex Rivera gave birth to three daughters, whose American citizenship offered her hope of staying in the land of opportunity. But with job prospects drying up for her husband, Ms. Rivera last week joined a phalanx of compatriots at the Mexican consulate in Los Angeles inquiring about obtaining Mexican citizenship for their children.

“We are thinking of returning to Mexico and want our daughters to have all the rights of Mexican nationals,” says Ms. Rivera, whose children are nine, five and three.

After a historic immigration wave, many Mexicans and other Latin Americans are preparing to return to their homelands amid the deepening recession here. Mexicans who reside in the U.S. sought Mexican citizenship for their U.S.-born children in record numbers last year.

The murder of nine-year-old Jordin Paulder

On June 5, nine-year-old Jordin Paulder, a towheaded boy with “chubby cheeks,” as the newspapers described him, was playing in the parking lot of the Chastain Apartments in Sandy Springs, Georgia, part of metro Atlanta. Jordin saw a car go by and called out to the occupants. The car had a bum tire, the lad shouted. The car stopped, and Santos Benigno Cabrera Borjas emerged, wielding a hatchet. He twice smashed Jordin in the face between the nose and forehead. The second blow buried the hatchet, which paramedics feared removing en route to the hospital. Jordin died. When police cornered Borjas as paramedics worked on Jordin, the ax-murderer tossed a rimmed tire at an officer, breaking his arm. Borjas rushed the cop, who shot him dead.

Three illegal immigrants are being held on $50,000 bonds for a vandalism and mayhem rampage that included beating a pregnant woman with a hose.

The three men, Jose Ramirez-Lopez, 26, Christian Onofre-Caba, 19, and Rosalino Gaspar, 25, were arrested Sunday north of Willcox, Arizona, in connection with assault on a pregnant woman and crime spree that includes charges of aggravated assault, kidnapping and burglary, Carol Capas, spokeswoman for the Cochise County Sheriff’s Department, told the Arizona Range News.

Police said the men smashed windows in one home, roamed the area making noise and acts of vandalism. They are also suspected of attacking a man with a small wooden bat and a knife.

They reportedly entered a home and assaulted a woman who was eight-months pregnant by repeatedly striking her with a rubber hose, before chasing a second man back to the bedroom and assaulting him with fists and a knife.

Girl of three Raped by Mexican Illegal Migrant Male in Newberg Oregon

The Newberg-Dundee Police Department is asking for the public’s help to find a migrant worker accused of assaulting a 3-year-old girl in the Newberg area.

Neptali Sanchez-Gonzales, 19, ran from a family’s home where he had rented a room after the girl’s mother confronted him, said Sgt. Tim Weaver, a police spokesman.

1990_ford_t-birdSanchez-Gonzales is described as 5-foot-7, 150 pounds, with black hair and brown eyes. He might be driving a red 1990 Ford Thunderbird, Oregon license 061BLT, with front-end damage.

Investigators found that Sanchez-Gonzales had lived in the area a short time and had no known family or friends here. He had found a job in agriculture, which Weaver said in the winter is mostly working for vineyards.

Investigators have called the case an isolated incident. But Sanchez-Gonzales’ status as a migrant worker means he could have lived almost anywhere, so other police agencies may be alerted, Weaver said.

ARPAIO ORDERS MOVE OF HUNDREDS OF ILLEGAL ALIENS TO THEIR OWN TENT CITY

Electric Fence to Minimize Escape Risk

(PHOENIX, AZ.) At 1:00 PM tomorrow, Wednesday, February 4, 2009, Maricopa County Sheriff Joe Arpaio will order of approximately 200 illegal aliens to be chained and marched into a separate area of Tent City, their new place of incarceration until their sentences are served and the illegal aliens are deported to their home countries.

tentcityThe move to Tent City frees up much needed space in the Sheriff’s hard facilities serving as a management tool for potential jail overcrowding, Arpaio says.

More importantly, the move is a financially responsible alternative to taxpayers already over burdened by the economic drain imposed by a growing number of illegal aliens on social services like education and healthcare.

The move also facilitates security and transportation issues as well as provides easier and quicker access for foreign government visits to these inmates, the Sheriff says.

The move to Tent City also makes room for the future. Now that the Arizona state government has given Arpaio back his $1.6 million dollars slated for fighting illegal immigration, more arrests by the Sheriff’s human smuggling unit and crime suppression operations are anticipated.

“We have expanded the tents to be able to house as many as 2500 inmates out of the 10,000 currently incarcerated in the jails,” Arpaio says. “As we planned the expansion, I decided to have a special area to house this particular population of inmate more effectively and safely. Starting tomorrow, Tent City will be their new address,” Arpaio says.

Tent City is Arpaio’s canvas incarceration compound which he opened in August of 1993. Since then, it has been a safe and cost effective way of housing inmates and has gained worldwide attention as a model jail program. The consolidation of a large number of illegal aliens into Tent City, Arpaio says, should pose no substantial security problems as the area where they will be housed is protected by an electric fence.

“This is a population of criminals more adept perhaps at escape,” the Sheriff says. “But this is a fence they won’t want to scale because they risk receiving quite a shock – literally.”

Tomorrow’s move is expected to take about an hour as the illegal aliens make their way from the Durango Jail complex to Tent City on Gibson Road. Traffic will be rerouted during the transfer, Arpaio says.

The inmates will enter Tent City through the west gate and pick up their bedding before making their way to their section of the tents.

They will be treated like all other inmates incarcerated here with two exceptions. Arpaio wants them to be instructed in American immigration laws, as a way to help them understand that the violation of these laws has serious consequences not only to them but to society as a whole. And anyone found to violate jail rules, may end up on a chain gang. This chain gang will work to clean the areas of the valley, which have been impacted by human trafficking trade.

The inmate march begins at 1:00 PM on Wednesday beginning at the entrance gate of Durango Jail on Gibson Street. The 220 inmates will march east to Tent City. TUCSON — A man who employed unauthorized workers at Sun Drywall and Stucco Inc. in Sierra Vista was sentenced to two months of home detention on Monday in U.S. District Court.

Omar Reyes pleaded guilty in an agreement to a misdemeanor for conspiracy to employ unauthorized aliens and continuing to employ illegal aliens.

During a hearing Monday, Judge Raner Collins called the offense is “very serious.” He sentenced him to 60 days of home detention and imposed a $500 fine. Reyes will not serve probation.

Reyes is one of eight people charged in March 2007 with conspiring to harbor or shield from detection illegal workers from Mexico and knowingly hiring or aiding in the hiring of the workers over a 12-month period. The other defendants are Efrain Silvain Avechuco, Edward Durgin, Ivan Hardt, Carol Hill, Joaquin Neave, Santiago Trejo Ramirez and Jose Gutierrez Tapia.

Assistant U.S. Attorney Munish Sharda, who is prosecuting the case, said Reyes is one of the least culpable defendants, and so he said the 60-day sentence is fair. Andrea Matheson, the defense attorney, agreed to the 60-day sentence.

Hill was sentenced in November to 14 months, with two months in prison and 12 months in home detention, a $10,000 fine and 500 hours of community service. Tapia was sentenced in December to a term of 12 months, with two months in prison and 10 months in home detention, and a $15,000 fine.

Durgin was sentenced in October to three years of probation. Neave was sentenced in January to three years of probation and a $1,000 fine. Hardt and Ramirez have pending cases. Avechuco is still a fugitive.

Protesters say ‘ICE destroys our communities’

The Federal Government Fair brought 66 federal agencies and approximately 145 representatives to the Satellite Student Union yesterday. In addition to bringing students, faculty and staff to check out government job opportunities, the fair attracted controversy and a protest over the presence of one government agency.

The U.S. Immigration and Customs Enforcement (ICE) agency is under the Department of Homeland Security. According to their Web site’s mission statement, the organization, “protects national security and upholds public safety by targeting criminal networks and terrorist organizations that seek to exploit vulnerabilities in our immigration system, in our financial networks, along our border, at federal facilities and elsewhere in order to do harm to the United States.”

Court Bans Illegal Immigrants From State Rehab

A Florida appellate court has ruled that illegal immigrants cannot benefit from a publicly funded state rehabilitation program for victims of brain and spinal cord injuries.

An administrative judge had previously determined that a state rule rendering illegal aliens ineligible for Florida’s Brain and Spinal Cord Injury Program is an “invalid exercise of delegated legislative authority.” The case involves an illegal immigrant from Mexico, living in central Florida’s Hardee County, who was injured when his vehicle was struck by a drunk driver.

The Mexican national enrolled in the rehab program, which aims to provide all eligible residents who sustain a traumatic brain or spinal cord injury the opportunity to obtain the necessary services enabling them to return to their community. With regional offices throughout the state, the program is partially funded with traffic-related fines, surcharges for driving under the influence of drugs and alcohol and license tag fees.

The Florida Department of Health challenged the illegal immigrant’s qualifications for the costly services, pointing out a state Administrative Code that specifically disqualifies those who don’t live in the state legally. This week the Court of Appeals for the First District of Florida agreed, reversing the administrative judge’s previous ruling.

In its seven-page decision the appeals court said that the program services constitute state public benefits under the 1996 federal Personal Responsibility and Work Opportunity Reconciliation Act and, because the Florida Legislature has not affirmatively provided that illegal aliens are eligible, they are not.

Yavapai Sheriff’s Office deputies stopped a white Chevrolet Suburban Saturday afternoon on the Interstate for impeding traffic and being overloaded with passengers. The vehicle had 12 passengers packed inside and none were wearing seat belts. The driver, who did not speak English, produced an obviously fake Mexican chauffeur’s license according to officers.

The driver and passengers were detained and officers from Immigration and Customs Enforcement (ICE) contacted to establish documentation status. ICE interviewed each detainee and confirmed all were illegal aliens and a hold was placed on the group.

A search of the vehicle revealed more bogus false Mexican chauffer licenses. Deputies also discovered the vehicle’s suspension had been modified to handle added passenger weight including additional leaf springs and higher capacity coil springs.

During a records check of occupants, the front seat passenger was found to have a prior deportation case from February 2008 after a DPS traffic stop. He was identified as Edgar Correa, 21.

All subjects taken to the Camp Verde Jail pending a transfer to ICE custody. Deputies identified the driver as Alberto Correa, 28. Edgar is his nephew. Alberto admitted he had been hired by a “coyote” in Phoenix who provided the Suburban vehicle along with $400 in gas money.

The 11 passengers had been picked up from a Phoenix drop house but the group’s destination was not clear. Deputies found that Alberto and Edgar were working together and profiting as human smugglers and both were booked on 11 counts of human smuggling. Alberto was additionally charged with possession of a forged instrument. Both are held without bond.

The remaining illegal aliens were eventually released to ICE custody pending deportation hearings. A majority of those released to ICE told deputies they had been smuggled into the United States after paying $1,600 dollars to a “coyote.”

Following a one month investigation, Oregon State Police (OSP) detectives arrested a Redmond-area man Monday on rape and sex abuse charges. Two victims were identified during the investigation and investigators are interested in learning any new information that may help in these cases.On January 26, 2009, OSP detectives arrested FRANCISCO JAVIER PANIAGUA GARCIA, age 22, from Redmond mexico but immigration status is witheld from the public and lodged him in the Deschutes County Jail on the following charges:

  • Rape in the First Degree
  • Sex Abuse in the First Degree (2 counts)
  • Attempted Rape in the First Degree
  • Sex Abuse in the Second Degree

The arrest following an investigation by OSP detectives from the Bend Area Command office into allegations that in December 2008 a 16-year old female victim went to the suspect’s Redmond residence for a party with friends. While at the residence, the victim allegedly was provided alcohol and at some point forcibly compelled the victim to have sexual intercourse with the suspect.

During the investigation, detectives learned of a second unrelated incident alleging the attempted rape of a 21-year old female.

FBI: Burgeoning gangs behind up to 80% of U.S. crime – USATODAY.com

Criminal gangs in the USA have swelled to an estimated 1 million members responsible for up to 80% of crimes in communities across the nation, according to a gang threat assessment compiled by federal officials.

The major findings in a report by the Justice Department’s National Gang Intelligence Center, which has not been publicly released, conclude gangs are the “primary retail-level distributors of most illicit drugs” and several are “capable” of competing with major U.S.-based Mexican drug-trafficking organizations.

“A rising number of U.S.-based gangs are seemingly intent on developing working relationships” with U.S. and foreign drug-trafficking organizations and other criminal groups to “gain direct access to foreign sources of illicit drugs,” the report concludes.

The gang population estimate is up 200,000 since 2005.

Legal price of hiring illegals

Today, Janco Composites (as a corporation), and its President (as an individual), pleaded guilty to criminal charges in federal court in South Bend.

Janco Composites faces five years of probation and a fine of $210-thousand to be paid in installments over a two year period.

Janco President Douglas Jaques—as an individual– faces one year of probation and a fine of $30-thousand.

The plea agreement indicates that Janco had a pattern and practice of hiring illegal Mexican immigrants, and that one of the illegal workers was part of the Human Resources Department.

In March of 2007, officials raided Janco’s Mishawaka factory. During the raid, 36-alleged undocumented workers were arrested.
